1. Eligibility & Legal Capacity

You must be at least 18 years of age and legally competent to enter into binding commercial contracts under the Indian Contract Act, 1872 to use this service or purchase digital plans. If you are registering on behalf of an agricultural business or partnership, you warrant that you possess full authority to bind that entity.

2. Customer Accounts & Security

When registering an account on FARMER ITS, you agree to:

• Provide true, accurate, current, and complete personal and business details.
• Maintain the confidentiality of your account credentials, passwords, and digital license keys.
• Notify FARMER ITS immediately of any unauthorized access or breach of security.

3. Software Licenses & Usage Rights

For ready software products (such as Agri Billing Software):

• FARMER ITS grants the customer a non-exclusive, non-transferable, revocable license to install and operate the software for their lawful business purposes in accordance with the purchased package (e.g., single PC or multi-user as specified).
• Customers may not decompile, reverse engineer, disassemble, resell, lease, or sub-license the software binaries without express prior written consent from FARMER ITS.

4. Website Development Scope & Milestones

For custom website development services:

• The scope of work, page count, and deliverables are strictly defined by the selected plan (e.g., up to 5 pages for Starter, up to 10 pages for Professional) or written custom quotation.
• Development timelines commence once the customer supplies all necessary project inputs (business logo, product photographs, text content, and hosting access).
• Any features, third-party integrations, or custom modules beyond the specified package scope will be quoted separately as billable custom work.

5. Pricing, Taxes & Payment Processing

All prices displayed on this website are in Indian National Rupees (INR).

• Payments are processed securely through Razorpay. Customers may pay using UPI, NetBanking, Debit Cards, or Credit Cards supported by Razorpay.
• Prices and features are subject to review and configuration by the business administrator. The final payable amount is confirmed and locked before checkout.
• Payment is required in full or according to the agreed milestone structure before software licenses are activated or final website deployments are completed.

6. Digital Delivery Model

All products and services offered are delivered electronically through customer account access, digital downloads, license keys, or remote cPanel deployment. Physical shipment and courier delivery are not applicable.

7. Annual Maintenance & Renewals

Initial software purchases grant perpetual access for the installed major version as defined in the plan. Domain names, web hosting server renewal fees, external SMS gateways, and optional Annual Maintenance Contracts (AMC) are renewable on an annual basis according to the terms specified in each plan.

8. Intellectual Property & Customer Materials

All software architectures, proprietary billing engines, and website designs created by FARMER ITS remain the intellectual property of FARMER ITS until full payment is settled. The customer warrants that all logos, images, and text supplied for their custom website do not infringe any third-party copyrights or trademarks.

9. Acceptable Use Policy

You agree not to use FARMER ITS software, services, or servers for any unlawful purpose, including the distribution of malicious scripts, spamming, fraudulent agricultural misrepresentations, or violating Indian cyber laws.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, FARMER ITS and Kirankumar V Gaikwad shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from data loss, server downtime caused by external hosting providers, or business interruptions. In all events, the total aggregate liability of FARMER ITS shall be limited to the total amount actually paid by the customer for the specific product or service giving rise to the claim.

11. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal dispute, claim, or difference arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts located in Chhatrapati Sambhajinagar, Maharashtra, India.
